Hence, it is a course of learning and gaining experience.<\/p>\n\n\n\n<p>As we all know, education is the most powerful weapon which can easily shape the destiny of both an individual as well as the whole country. Moreover, if we look at the reasons responsible for defining the boundaries between a developed, developing and under-developed nations, education appears as the single most significant factor whirling the wheel of progress and advancement in the developed nations. Also, it has been recognized that an educated citizen not only improvise the economic and social status of the concerned nation but the political scenario as well.<\/p>\n\n\n\n<p>Further, the importance of education is indisputable for every single person. It is an unwavering component for the development and growth of human civilization. Even though education has a momentous effect on life, regular education is not the same in different areas. As a consequence, plans and policies are being made to resolve these issues. Furthermore, without education, life would be both disadvantageous and devastating as education helps in imparting moral values which are nowadays missing in our youth and also require to be addressed carefully for creating a better society.<\/p>\n\n\n\n<p>Further, due to the continuous efforts made by our academicians, NGO\u2019s, educationists and civil society groups, who followed a rights-based approach, resulted in the passing of 86th constitutional amendment by the parliament. Further, the 86<sup>th<\/sup> constitutional is all about article21A, which made the Right to Education a fundamental right. Consequently, \u201cRight to Free and Compulsory Education Act\u201d was passed by the President of India on 26 August 2009, Moreover, the same got published in the official gazette of India on 27 August 2009.<\/p>\n\n\n\n<p>Furthermore, after the enforcement of the act on 01 April 2010, India has become one of the 135 nations to make education a fundamental right for its citizens. Moreover, the enforcement of said act put the concept of Right to Education at par with the Right to Life. Also, this act bounds all the stakeholders like schools, parents, society, states and the central governments to play their roles to provide free and compulsory education to the children aged between the 6-14 years.&nbsp;<\/p>\n\n\n\n<p>The Right to Education act principally supports and encourages the notion of \u201cfree and compulsory\u201d education. Here,&nbsp;the term free education&nbsp;means that no child is allowed to pay any amount of fee or any kind of charges levied for completing and getting education apart from the child whose parents are capable of paying fees and also affording all other sorts of child-related expenses. Further, the term compulsory education&nbsp;means that it is the government\u2019s responsibility along with all the concerning local authorities to check for the proper attendance of the students, to make sure proper admission is taking place and also to take care for the fulfilment of the fundamental education of every child.<\/p>\n\n\n\n<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_73 id=\"Judicial_Pronouncements_concerning_Right_to_Education\"><\/span><strong>Judicial Pronouncements concerning Right to Education<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Indian Constitution is recognized to be a document committed to social justice. According to expert opinion, literacy forms the keystone for making the provisions relating to equality of opportunity a reality. Thus, the Indian Constitution has characterised education as the essence of social revolution, and the same is apparent from its education-specific articles.<\/p>\n\n\n\n<p>Further, the judicial announcement from which the right to education originated as a fundamental right was the <strong>Mohini Jain v. State of Karnataka<\/strong>. In this case the Apex Court by way of a division bench comprising of Justice R.M Sahai and Kuldip Singh, deciding on the issue of charging capitation fee held that, the right to education streams directly from the right to life. Further, an individual\u2019s the right to life, and dignity cannot be guaranteed unless it is supplemented by the right to education.<\/p>\n\n\n\n<p>A five-judge bench further observed the rationality of the above-mentioned judgment in the case, <strong>J.P. Unnikrishnan v. State of Andhra Pradesh<\/strong>. In this case, the apex court while deciding the issue concerning the enforceability and the extent of the right to education clarified that, the right to education also means that a citizen has a right to call upon the state to give educational facilities to him, that too within the limits of its financial capacity and development. Further, in this case, the Hon\u2019ble Supreme Court also held that education up to the age of 14 years is a fundamental right. Hence, it is the state\u2019s responsibility to provide both the education facilities and opportunities, and moreover the same has been enjoined under article 39 (e) and (f) of the Indian Constitution.&nbsp;<\/p>\n\n\n\n<p>The same was further reiterated by the Hon\u2019ble Supreme Court in the case named <strong>Bandhua Mukti Morcha, etc. v. Union of India<\/strong>. Lastly, in the case of <strong>Maharashtra State Board of Secondary and Higher Education v. K.S. Gandhi<\/strong>, the apex court held that right to education at the secondary stage is a fundamental right.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Features_of_the_Right_to_Free_and_Compulsory_Education_Act_2009\"><\/span><strong>Features of the Right to Free and Compulsory Education Act, 2009<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following listed are the features annexed with the Right to Education (RTE) Act, 2009 \u2013<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>The RTE Act aims at providing&nbsp;primary level education to all children of age 6 to 14 years.<\/li><li>It enforces Education as a&nbsp;Fundamental Right under Article 21<strong>.<\/strong><\/li><li>The act obligates&nbsp;25 per cent reservation for the disadvantaged sections&nbsp;of the society where disadvantaged groups comprise of \u2013<ol><li>Scheduled Caste and Scheduled Tribes<\/li><li>Socially Backward Class<\/li><li>Differently-abled<\/li><\/ol><\/li><\/ol>\n\n\n\n<ol class=\"wp-block-list\"><li>As per this act, every child has the fundamental right to obtain free and compulsory education.<\/li><li>The RTE act makes provisions regarding the non-admitted students to be admitted at the right age to the specified class.<\/li><li>This act specifies the different responsibilities of both the government and local authorities to make sure to provide free and compulsory education.<\/li><li>It also lays down provisions regarding the Pupil Teacher Ratios (PTRs).<\/li><li>It also guarantees that the employment of every teacher, whether in rural and urban areas is in a balanced way, and must maintain a proper ratio.<\/li><li>It also lay down rules and regulations for maintaining the infrastructure of the schools along with proper working hours for the teachers etc.<\/li><li>It also recommends employing well-educated and trained teachers.<\/li><li>It also provides for the prohibition on the deployment of teachers for the non-educational work, other than decennial census, state legislatures and parliament, elections to local authority and disaster relief.<\/li><li>This act provides for the appointment of teachers with the necessary entry and academic qualifications.<\/li><li>This act strictly prohibits \u2013<ol><li>Both physical punishment and mental harassment<\/li><li>Screening procedures for the admission of children<\/li><li>Capitation fee<\/li><li>Private tuition by the teachers<\/li><li>Running of schools without any recognition.<\/li><\/ol><\/li><\/ol>\n\n\n\n<ol class=\"wp-block-list\"><li>It also focuses on making the child free of trauma, fear and anxiety by way of a system of child-centred and friendly learning.<\/li><li>This act wants to create a system in which full knowledge in respect of subject and moral values should also be provided. Moreover, as per this act, not a single child could be remained deprived of their fundamental and specifically the most basic rights.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Achievements_of_the_Right_to_Education_Act_2009\"><\/span><strong>Achievements of the Right to Education Act, 2009<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following listed are the achievements of the RTE Act, 2009 &#8211;<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>The RTE Act has effectively managed to increase the count of enrolment in the upper primary level, i.e., class 6 to 8.<\/li><li>Stricter norms concerning infrastructure resulted in improved and better school infrastructure, especially in rural areas.<\/li><li>More than 3.3 million students got admission under 25 per cent quota norm under the <a rel=\"noreferrer noopener\" aria-label=\"RTE Act (opens in a new tab)\" href=\"https:\/\/mhrd.gov.in\/rte\" target=\"_blank\">RTE Act<\/a>, 2009.<\/li><li>This act made education comprehensive and accessible nationwide.<\/li><li>Removal of the \u201cno-detention policy\u201d has brought accountability in the elementary education system.<\/li><li>The Government has also started an integrated scheme, for promoting school education named as&nbsp;the <strong><a href=\"http:\/\/samagra.mhrd.gov.in\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Samagra Shiksha Abhiyan (opens in a new tab)\">Samagra Shiksha Abhiyan<\/a>. <\/strong>This scheme&nbsp;is further divided into three schemes listed below \u2013<ol><li>Sarva Shiksha Abhiyan (SSA)<strong>&nbsp;<\/strong><\/li><li>Rashtriya Madhyamik Shiksha Abhiyan (RMSA)<\/li><li>Centrally Sponsored Scheme on Teacher Education (CSSTE).<\/li><\/ol><\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Drawbacks_of_the_Right_to_Education_Act_2009\"><\/span><strong>Drawbacks of the Right to Education Act, 2009<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following listed are the limitations and drawbacks of the RTE Act, 2009 \u2013<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>The age group for which the Right to Education is available ranges from 6 to14 years of age only. This said limit could be made broader and encompassing by expanding it further to 0 \u2013 18 years.<\/li><li> This act does not focus on the quality of learning, as shown by multiple&nbsp;ASER reports<strong>. <\/strong>Therefore, the RTE Act seems to be generally input-oriented.<\/li><li>Five states, namely Goa, Mizoram, Manipur, Sikkim and Telangana, have not even issued a notification regarding 25 per cent seats for the underprivileged children of the society under the RTE.<\/li><li>Government focuses more on the given statistics of RTE rather than the quality of learning.<\/li><li>Lack of teachers affects the pupil-teacher ratio authorized by the RTE, which in turn impacts the quality of teaching.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Steps_yet_to_Be_taken_by_the_government\"><\/span><strong>Steps yet to Be taken by the government&nbsp;<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following listed are the points on which the government is still required to work &#8211;&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Minority Religious Schools need to be brought under the ambit of Right to Education Act, 2009.<\/li><li>The government is required to focus more on teacher training programs.<\/li><li>The government is also required to focus on providing quality education instead of the quantity of education.<\/li><li>Steps are required to be taken to make the teaching profession more attractive.<\/li><li>Lastly, society as a whole need to be supportive of education for children without biases.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"No_Detention_Policy\"><\/span><strong>No Detention Policy<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The No Detention Policy was unleashed as a part of CCE (Continuous and Comprehensive Evaluation) scheme under the RTE Act in 2010.<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>As per this scheme, students up to class 8<sup>th<\/sup> are necessarily promoted to the next class without being held back even if in case they do not get a passing grade.<\/li><li>This policy was made to make sure that not even a single child will be held back in any class or expelled from school till the completion of elementary education.<\/li><\/ol>\n\n\n\n<p>But, recently, the no-detention policy has been abolished by the Right to Education Amendment Act, 2019.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Right_of_Children_to_Free_and_Compulsory_Education_Amendment_Act_2019\"><\/span><strong>Right of Children to Free and Compulsory Education (Amendment) Act, 2019<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Right of Children to Free and Compulsory Education (Amendment) Act, 2019 was passed by the Parliament on 03 January 2019 received the President\u2019s assent on 10 January 2019. This act has now been notified in the official Gazette of India. The bills seek to abolish the no-detention policy in schools.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_there_was_a_need_for_amendment\"><\/span><strong>Why there was a need for amendment?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In the recent years, both the States and Union territories have been continuously raising the issue of adverse impact on the learning levels of children as section 16 of the RTE Act, 2009 prohibited holding back of children in any class until the completion of the elementary education.<\/p>\n\n\n\n<p>Thus, the amendment to the concerned section was proposed to improve and upgrade the learning outcomes in the elementary classes and also to empower the appropriate Government to take a verdict as to whether to hold back a child in the 5th class or in the 8th class or in both classes, or not to hold back a child in any of the class, till the end of elementary education.<\/p>\n\n\n\n<p>As per the Union HRD Minister, over 25 states favoured the abolition of the no-detention policy.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Significance_of_the_Right_to_Education_Amendment_Act_2019\"><\/span><strong>Significance of the Right to Education Amendment Act, 2019<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The legislation is significant in nature as it brings accountability in the system of elementary education.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Provisions_of_the_Right_to_Education_Amendment_Act_2019\"><\/span><strong>Key Provisions of the Right to Education Amendment Act, 2019<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following listed are the key changes or provisions bought in the Right to Education Amendment Act, 2019 &#8211;&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>This act seeks to amend the provisions of the Right to Education (RTE) Act by abolishing the \u201cno-detention\u201d policy in schools. As because of this policy, no student was allowed to be detained or held back up to class VIII.<\/li><li>There shall be a regular examination in the 5<sup>th<\/sup> class and in the 8<sup>th<\/sup> clas<strong>s<\/strong>&nbsp;at the end of every academic year.<\/li><li>If in case a child fails in the said examinations, he shall be&nbsp;given an opportunity for a re-examination&nbsp;within&nbsp;two months&nbsp;starting from the date of declaration of the result.<\/li><li>Such a child will be provided with two months of remedial teaching in order to perform better in the re-examinations.<\/li><li>TheState Government may also allow schools to hold back a child&nbsp;in the 5<sup>th<\/sup> class or the 8<sup>th<\/sup> class or in both the classes if in case he or she fails in the re-examination.<\/li><li>The&nbsp;State Government may also decide that not a single child should be held back in any class until the completion of his or her elementary education.<\/li><li>No child shall be debarred from a school&nbsp;until the completion of his or her elementary Education.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Right to Education act has successfully achieved some of its objectives. However, this Act would have been resulted in more successful if it was not limited only to children under the age of 14 years. Instead, this act should have focused on the democratic access so that those who were deprived of this right in their initial age of schooling could have been benefitted from the RTE in a holistic manner.&nbsp;<\/p>\n\n\n\n<p>Furthermore, more amount of counselling centres should be created for the parents in order to create awareness about the importance of education in one\u2019s life, as they play a crucial role in ensuring the success of this said act. If the RTE has to be effective, then the government is required to create an unblemished policy framework and also schools are required to adhere to the governing codes and moral ethics.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u2018EDUCATION\u2019- This word merely means to acquire knowledge, values, skills, and beliefs in different facets of our life.
