order passed by a higher court to a lower court or courts, commanding them to either do something or to stop them from doing something. Further, a writ petition is a kind of written direction in the name of the court. It commands the court to act in an exact way.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Types_of_Writ\"><\/span>Types of Writ<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Furthermore, in India, the power to issue a writ petition is mainly a provision, i.e., the Right of Constitutional Remedies to every citizen. This said right acts as a guarantor of all other fundamental rights available in India. In total, there are five <a href=\"https:\/\/lawyerinc.net\/in\/special-leave-petition\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"types of writ petition (opens in a new tab)\">types of writ petition<\/a> available in the Indian constitution, which one can file either before a High Court or the Supreme Court. The following listed are the types of writs available in India \u2013<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>\n\tHabeas\n\tCorpus\n\t<\/li><li>\n\tMandamus\n\t<\/li><li>\n\tProhibition\n\t<\/li><li>\n\tCertiorari\n\t<\/li><li>\n\tQuo\n\tWarranto\n<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Writ_Petition_under_Constitutional_Law\"><\/span>Writ Petition under Constitutional Law<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In our Indian legal system, an individual can easily file a writ petition under Article 226 or Article 32 of the Indian Constitution either in the High Court or the Supreme Court of India. Further, Article 32 and Article 226 of the Indian constitution talk in detail about the types, process, and meaning of the writ petition, which are to be followed by the petitioner whenever there is a violation of fundamental rights.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Article_32\"><\/span>Article 32<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>It is a fundamental right guaranteed by our Indian Constitution. This article provides for constitutional remedies against the infringement of the fundamental rights of a citizen. Further, the jurisdiction of the Hon\u2019ble Supreme Court to issue writs is valid on the whole of India. However, it is significant to note that the Supreme Court is not bestowed with the right to issue writs against any administrative verdict, which is in contravention of the ordinary law.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Article_226\"><\/span>Article 226<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Article 226 confers authority on the High Courts to issue a writ in the territorial zone over which they have jurisdiction. This article provides constitutional remedies for the implementation and protection of fundamental rights. Further, the writ jurisdiction of the High Court is much wider than the Supreme Court. The reason behind this is that the High Court can issue writs not only for the implementation and protection of a fundamental right but also for any act which is in contravention to the law or any grievance of a law.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_is_a_Writ_Petition_needed\"><\/span>Why is a Writ Petition needed?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Writ petition is usually filed whenever there is a violation or infringement of rights, or any kind of injustice is served to any individual or aggrieved. Further, the concept of a Writ Petition is basically a remedial measure provided by our Indian Constitution against the authority regulating and administering law and order in the country for the following listed reasons &#8211;<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>\n\tTo\n\tassist citizens, defend their rights against the court orders.\n\t<\/li><li>\n\tTo\n\tprovide an alternative to the aggrieved person when impugned order\n\tis not opposed by the appeals made to the authorized higher\n\tauthorities in the legal system.\n\t<\/li><li>\n\tTo\n\tensure justice served but not justice denied.\n<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_can_file_a_writ_petition\"><\/span>Who can file a writ petition?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A\nwrit petition can be filed by any individual or aggrieved person\nwhose fundamental rights are being infringed or violated. However, it\nis pertinent to note that the writ of Habeas Corpus can be easily\nfiled on behalf of the aggrieved person also. Whereas in the case of\nQuo Warranto, the said writ petition can be filed by any person\nregardless of his right being infringed or not.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Where_can_a_Writ_Petition_be_filed\"><\/span>Where can a Writ Petition be filed?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Writ petitions can be filed in either in the Supreme Court or in the High Court of that respective State where the fundamental right has been infringed or violated. Further, in the case of Habeas Corpus, a writ is not qualified to be issued by the High Court if the concerned person is detained outside its jurisdiction.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_to_File_a_Writ_Petition\"><\/span>How to File a Writ Petition<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following listed are the steps that should be duly followed while filing a writ petition &#8211;<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>\n\tThe\n\tfirst and foremost step is to ascertain whether the&nbsp;cause of\n\taction is remedial&nbsp;by the issuance of a writ.\n\t<\/li><li>\n\tIn\n\tthe next step, the aggrieved person is required to&nbsp;file a\n\tpetition&nbsp;either with the help and assistance of a lawyer or by\n\thimself annexing all the necessary documents, affidavit, and the\n\tprayer.\n\t<\/li><li>\n\tFurther,\n\tthis petition is then required to be filed at the filing counter of\n\tthe particular High Court. Then a&nbsp;future date for the\n\tconsideration&nbsp;of the said matter will be given.\n\t<\/li><li>\n\tOn\n\tthe date of consideration, the lawyer or the concerned person\n\thimself can plead the matter. However, it is significant to note\n\tthat the&nbsp;High Court has the autonomy to either accept or\n\tdismiss the petition.\n\t<\/li><li>\n\tIf\n\tin case the court admits&nbsp;or accepts the said petition, then a\n\tnotice is sent to the opposite party,&nbsp;and the\n\tcourt will give another date of hearing.\n\t<\/li><li>\n\tLastly,\n\ton the date of hearing, all the&nbsp;contents are well-settled,&nbsp;and\n\tthe Court&nbsp;grants relief as it deems appropriate.\n<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Important_points_to_remember_regarding_Writ_Petition\"><\/span>Important points to remember regarding Writ Petition<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nfollowing listed are the points that are to be taken into\nconsideration while drafting or filing a writ petition &#8211; \n<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>\n\tIf\n\tin case the&nbsp;petition is&nbsp;dismissed by the court,&nbsp;no\n\tfresh petition&nbsp;is allowed to be filed on the&nbsp;same cause of\n\taction.\n\t<\/li><li>\n\tIt\n\tis always advisable that the aggrieved person must&nbsp;consult a\n\tlawyer&nbsp;and, instead of himself, let the lawyer file the\n\tpetition using his expertise.\n\t<\/li><li>\n\tFurther,\n\tin the case of a&nbsp;Habeas Corpus petition, the petition can also\n\tbe filed by the aggrieved in the form of a&nbsp;simple application.\n\t<\/li><li>\n\tDo\n\tnot file a vexatious or a frivolous petition.\n<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<div class=\"shadow2\">The\nconcept of the Writ petition was brought in our Constitution in order\nto help a victim if in case he or she is deprived of any basic or\nfundamental right or any injustice is made to him or to help the said\nperson in fighting against the decision taken by the last legal\nauthority.
