Further, Caveat Petition Filing means submitting a notice either to the court or to any Public Official requesting them not to take any further action in a particular case without hearing the party filing the caveat application. <\/p>\n\n\n\n<div class=\"wp-block-button aligncenter\"><a class=\"wp-block-button__link has-text-color has-very-dark-gray-color has-background has-pale-cyan-blue-background-color\" href=\"https:\/\/lawyerinc.net\/in\/caveat-filing\">Assistance in drafting and filing of Caveat Application<br><\/a><\/div>\n\n\n\n<p>Further, the concept of Caveat Filing is mention under\nsection 148A of the Code of Civil Procedure, 1908. This section was inserted by\nway amendment act, 1976 and provided the right to file a Caveat to any individual\nhaving an interest in some legal proceeding regarding a certain subject matter which\nis about to be started before any court<\/p>\n\n\n\n<p>Furthermore, it is noteworthy to note that a caveat\nremains in force for a period of 90 days starting from the date of caveat\nfiling. &nbsp;<\/p>\n\n\n\n<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_73 counter-hierarchy ez-toc-counter ez-toc-grey ez-toc-container-direction\">\n<div class=\"ez-toc-title-container\">\n<p class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_Caveat_Petition\"><\/span><strong>What is Caveat Petition?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nword \u2018Caveat\u2019 is nowhere defined in the Code of Civil Procedure, 1908. However,\nthe definition of the term \u201ccaveat\u201d was given in the case of&nbsp;<em><strong>Nirmal Chand<\/strong><\/em><strong><em>&nbsp;<\/em>v<\/strong><strong><em>.&nbsp;<\/em><\/strong><em><strong>Girindra Narayan<\/strong><\/em>. In this case, the\nCourt held that a Caveat is a warning or caution given by an individual to the\nCourt, asking them not to take any further action or grant any relief to the\nother side, without providing notice to the caveator and also without giving him\nan opportunity of being heard. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Objective_behind_introducing_the_provisions_for_Filing_of_Caveat_Petition\"><\/span><strong>The Objective behind\nintroducing the provisions for Filing of Caveat Petition<\/strong><strong><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The underlying objective of introducing\nthe provisions for filing of caveat petition are as follows \u2013<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>The caveat assists in safeguarding and protecting the interest of those individuals against whom an order may be passed by way of an application filed by an aggrieved party in suit or proceeding. Further, for filing a caveat petition, it is not mandatory or compulsory that the person or an individual lodging it must be a party to the suit. Hence, the people who are, although not the party to the suit but are affected by the order passed, are also qualified to apply caveat.<\/li><li>Further, <a href=\"https:\/\/lawyerinc.net\/in\/caveat-filing\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"caveat filing (opens in a new tab)\">caveat filing<\/a> also prevent commencement of multiple proceedings as all those individuals who are not only concerned with the subject-matter of the case but are also affected by the orders passed. However, not a party can join in with their agendas in the same proceeding.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_is_eligible_to_file_a_Caveat_Petition\"><\/span><strong>Who is eligible to file a Caveat Petition?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Caveator is an individual who\napprehends that if a case is either filed in court or is about to be filed in\ncourt, in which he or she has an interest, then, in that case, he or she can file\na caveat petition. Further, a Caveator can also move an application for obtaining\ninterim relief. Furthermore, a Caveator is also qualified to become both the\nnecessary as well as the proper party. Moreover, a person who is affected by an\norder passed by the court, can file a petition for caveat, although he or she\nis not a party to the said case.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Where_can_a_Petition_for_caveat_be_Filed\"><\/span><strong>Where can a Petition for caveat be Filed?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A\nCaveator can lodge or file a petition for caveat in any Civil Court of the original\njurisdiction, the Appellate Court, High Court, and the Supreme Court. Further,\nthe term Civil Courts include Forum, Tribunal, Courts of Small Causes, and\nCommissions. <\/p>\n\n\n\n<p>However,\nin&nbsp;the case named <em><strong>Deepak Khosla<\/strong><\/em><strong><em>&nbsp;<\/em>v<\/strong><strong><em>.&nbsp;<\/em><\/strong><em><strong>Union of India &amp; Ors<\/strong><\/em><strong><em>,<\/em><\/strong>\nit was held that Section 148A of the Code of Civil Procedure, 1908, can be\napplied only to the civil proceedings and not against the petitions filed under\nthe Criminal Procedure Code or any petition made under&nbsp;the provisions of Article\n226&nbsp;of the Constitution of India.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_Procedure_for_Filing_a_Caveat_Petition\"><\/span><strong>What is the Procedure\nfor Filing a Caveat Petition?<\/strong><strong><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A Caveat Petition can be filed in\nthe Civil Court of the Original Jurisdiction, the Appellate Court, the High\nCourts, and the Supreme Court. Further, the rules, regulations, and the format\nof the Caveat Petition is almost similar for most of the Courts. <\/p>\n\n\n\n<p>Furthermore, the Caveator is\nrequired to provide his basic information like his name and address. Moreover,\nhe is also required to provide the name and address of the possible applicant\nor the plaintiff or appellant, subject matter of the proceedings, the nature of\nthe legal proceedings apprehended to be filed against him in the future, brief\ndetail or summary of the earlier proceeding filed, if in case any, from which\nthe present legal proceedings shall reap, etc.<\/p>\n\n\n\n<p>It shall be taken into\nconsideration that a Petition for filing caveat is required to be signed by the\nCaveator, who has presented the same to the authorized Court Officer together\nwith the Vakalatnama or the Undertaking of the appointed Advocate for the possible\nproceedings who shall represent the Caveator.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Is_there_any_Prescribed_Format_for_drafting_a_Caveat_Petition\"><\/span><strong>Is there any Prescribed Format for drafting a Caveat\nPetition? <\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As such, there is no set\nand standard form prescribed by the Code regarding the caveat petition.\nHowever, it shall be prudent that a petition for filing caveat is required to\nbe filed in the form of a normal petition containing all the specific details and\nparticulars of the applications. Moreover, the Caveator in caveat petition must\nalso mention about his legal right to appear before the court. <\/p>\n\n\n\n<p>Further, it shall be noteworthy\nto note that for the requirement of entries, the stamp reporter or the registry\nis required to maintain a register in which all the caveat filing is entered.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_all_does_a_Petition_includes_in_it\"><\/span><strong>What all does a Petition includes in it?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A caveat Petition given to the court that some actions\nmay not be taken without informing and giving an opportunity of being heard to\nthe Caveator. Further, a petition for filing caveat must contain the following\nlisted information \u2013<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Name of the Caveator;<\/li><li>Address of the Caveator\nwhere the said notice would be sent;<\/li><li>The name of the concerned\ncourt where such a caveat petition is filed;<\/li><li>The total number\nof suits and the total number of appeals, if in case applicable;<\/li><li>Brief details\nabout the concerned suit or appeal, which is likely to be filed;<\/li><li>Name of all the probable\nplaintiffs or the appellants along with the respondents<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Common_mistakes_made_during_the_time_of_Caveat_Filing\"><\/span><strong>What are the Common mistakes made during the time of Caveat\nFiling?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following listed are the common mistakes or errors\nthat are made during the filing of Caveat \u2013 <\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>A petition for caveat is filed together in support of an application. Further, it is noteworthy to remember that a caveat can be file only in against of an application;<\/li><li>Usually, in the <a href=\"https:\/\/lawyerinc.net\/in\/caveat-filing\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"case of caveat filing (opens in a new tab)\">case of caveat filing<\/a>, Caveator forgets or unable to serve a notice to the applicant, which is again mandatory and compulsory under Section 148A of CPC.<\/li><li>Generally, Caveator claim that an order or a judgment passed by the court was incorrect because the said notice was given, even after the expiration period. Then it shall be relevant to note that after the expiry of 90 days, a fresh caveat is required to be filed.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_Time_Limit_for_Filing_a_Caveat_Petition\"><\/span><strong>What is the Time Limit for Filing a Caveat Petition?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As provided by clause 5\nof section 148-A, a caveat filed stays in force for 90 days. If the application\nis filed within these 90 days, then the court, along with the applicant, has to\nprovide notice to the Caveator. <\/p>\n\n\n\n<p>However, if in case no application\nis filed within 90 days, then no one has the legal duty to inform the Caveator\nabout the same, i.e., if the application is lodged after the expiry of 90 days,\nthe caveat filed stands null and void. <\/p>\n\n\n\n<p>But it shall be taken into\nconsideration that if the Caveator still wants himself to be informed about the\ncase filed or is about to be filed, then, in this case, a fresh caveat is\nrequired to be lodged for the next 90 days.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In\nthe end, I want to conclude by stating that section 148A of the Code of Civil\nProcedure, 1908 is substantive in nature and gives the right and power to any\nperson or individual who has apprehension or fear that a case against him is\neither filed or is about to be filed in a court in any manner, to lodge or file\na caveat in the court. Further, a caveat is allowed to be filed in only civil\nproceeding and not in criminal proceedings. <\/p>\n\n\n\n<div class=\"shadow3\">Normally,\na caveat filed under Section 148A of the code of civil procedure, 1908, will\nremain in force for 90 days starting from the date of its filing. Further,\nafter the completion of 90 days, a caveat filed may be renewed.
