Further, it provides the related aggrieved party special permission to appeal in the Apex court against any the judgment or order passed by any Court or tribunal within the territory of leave\npetition (SLP) means taking of a special permission by an individual for being\nheard in an appeal against the order or judgment passed by any High court,\nCourt, or tribunal.&nbsp;Therefore, SLP is not an appeal but a petition filed regarding\nan appeal. <\/p>\n\n\n\n<p>So, once an SLP is filed, the Hon\u2019ble Supreme Court may hear the substance, and if it considers fit, it may grant the \u2018<strong>leave<\/strong>\u2019 and convert that said petition into an <strong>\u2018appeal.\u2019<\/strong> Hence, an <strong>SLP<\/strong> shall become an Appeal only if the Hon\u2019ble Supreme Court has granted the leave. Thereafter, the <strong>Supreme Court<\/strong> will hear the concerned matter and <strong>pass judgment<\/strong>.<\/p>\n\n\n\n<div class=\"wp-block-button aligncenter\"><a class=\"wp-block-button__link has-text-color has-very-dark-gray-color has-background has-pale-cyan-blue-background-color\" href=\"https:\/\/lawyerinc.net\/in\/special-leave-petition\"><strong>Assistance in filing of Special Leave Petition<\/strong><br><\/a><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_Can_File_an_SLP\"><\/span><strong>Who Can File an SLP?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Any aggrieved person is eligible to file an SLP in the <strong>Apex Court<\/strong>. The said petition is filed against the order or judgment passed or of refusal of the grant of certificate.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_can_a_Special_Leave_Petition_be_Filed\"><\/span><strong>When can a Special Leave Petition be Filed?<\/strong><strong><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The appeal in the form of a special\nleave petition can be made in a case where any substantial question of law is involved\nor where gross injustice has been caused. Further, the judgment, order, or decree\nagainst which the appeal is being filed must have the character of judicial\nadjudication. This means that purely executive or administrative order or\nruling cannot be considered as a matter of appeal. Further, it is also relevant\nto note that the authority whose&nbsp;judgment, order, or decree is being\nappealed against should fall under the purview of a court or a tribunal.<\/p>\n\n\n\n<p>Furthermore, the Special Leave\nPetition (SLP) will not apply to any judgment, decree or order passed by any\ncourt or tribunal relating the armed forces. This is the only exclusion given\nin clause 2 of Article 136 in our Indian Constitution.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Circumstances_Under_Which_an_SLP_Can_Be_Filed\"><\/span><strong>What are the Circumstances Under Which an SLP Can Be Filed?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following listed are\nthe situations or the circumstances under which an SLP can be filed in the\nSupreme Court \u2013<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>A Special Leave Petition (SLP) may be filed against\nany judgment, order decree, or the sentence of any Court or Tribunal within the\nterritory of India, for both criminal and civil subject matter.<\/li><li>An SLP can also be filed if in the respective High\nCourt has refused to grant the needed Certificate of Fitness for Appeal to the Apex\nCourt to the concerned aggrieved as under other relevant provisions.<\/li><li>However, the above two mentioned provisions do not\napply to any tribunal or court constituted under any law concerning the Armed\nForces.<\/li><li>An SLP is required to be filed within ninety days\nagainst the impugned order passed by the Court or tribunal.<\/li><li>Further, the said period is reduced to sixty days\nif the High Court has refused to issue the Certificate of Fitness to Appeal to\nthe aggrieved person.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Rules_Regarding_a_Special_Leave_Petition\"><\/span><strong>What are the Rules Regarding a Special Leave Petition?<\/strong><strong><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In some of the leading case laws,\nthe following listed rules have been established \u2013<\/p>\n\n\n\n<p>By means of this article, the Apex\nCourt can grant special leave in the civil, criminal, or the Income tax-related\ncases, or the cases from various tribunals and any other variety of case. <\/p>\n\n\n\n<p>Further, SLP can also be filed if\nin case a High Court does not approve the fitness for appeal to the Supreme\nCourt. Normally, a private party other than the complainant must not be\npermitted to appeal.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_Time_Duration_for_Filling_SLP\"><\/span><strong>What is the Time Duration for Filling SLP?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The time frame for filing an SLP against any judgment passed\nby the High Court is 90 days starting from the date of the judgment. However, it\nis significant to note that there is flexibility provided at the discretion of\nthe Supreme Court. <\/p>\n\n\n\n<p>Further, a Special Leave Petition can be filed within a\nperiod of 60 days against the order of the High Court refusing to issue the\ncertificate of fitness for appeal to the Supreme Court.<strong><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Powers_Conferred_on_The_Supreme_Court_Under_Article_136_of_the_Constitution\"><\/span><strong>What are the Powers Conferred on The Supreme Court Under Article 136 of the\nConstitution?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following listed are\nthe powers conferred on the Supreme Court by way of Article 136 of the\nConstitution \u2013 <\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Article 136 plays a crucial role as it provides the\nSupreme Court with a special power known as the \u201cresidual power\u201d to step up\nwhenever it feels that there is any kind of gross injustice involved or when\nthere is a substantial error of law apparent on the face of the concerned case.\nThe main objective of this power is to lay down an extraordinary jurisdiction\nof the Supreme Court in which an aggrieved person can approach to get the grave\nmiscarriage of justice rectified and also to pronounce accurate law on that\nsubject.<\/li><li>It is noteworthy to note that the Apex Court does\nnot function as a regular court in which one can go and file the appeal against\nany order or judgment passed by any high court or any other court. Hence, one\nshould approach the Supreme Court only in exceptional circumstances and not for\nthe regular course of Litigation.<\/li><li>Further, the powers conferred by way of Article 136\nare discretionary. This means whenever an aggrieved person approaches the Apex\nCourt by way of Special Leave Petition (SLP), he or she is requesting to be\nable to make an appeal and be heard by the Supreme Court, although it is not\nthe regular course of action.<\/li><\/ol>\n\n\n\n<div class=\"shadow3\"><ul class=\"wp-block-list\"><li><a href=\"https:\/\/lawyerinc.net\/learning\/procedure-for-filing-a-caveat-petition-in-india\/\">Procedure For Filing A Caveat Petition In India<\/a><\/li><li><a href=\"https:\/\/lawyerinc.net\/learning\/what-is-the-procedure-for-filing-a-writ-petition-in-india\/\">What Is The Procedure For Filing A Writ Petition In India?<\/a><\/li><\/ul><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_Procedure_for_Filing_a_Special_Leave_Petition\"><\/span><strong>What is the Procedure for Filing a Special Leave\nPetition?<\/strong><strong><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following listed are the steps which are to be followed for filing a\nSpecial Leave Petition \u2013 <\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>The Supreme\nCourt has a pre-set format for the filing of the SLP in Form no. 28.<\/li><li>The SLP must lucidly\nstate all the facts clearly in order to convince the Apex Court that the\npresent SLP is maintainable and deserves to be heard by the Court.<\/li><li>All the\ndetails of the parties must be mentioned along with the court or the tribunal\nfrom which the impugned order has been passed.<\/li><li>The petition\ndrafted must clearly state the Question of Law involved.<\/li><li>All the\ngrounds of the appeal must also be clearly mentioned.<\/li><li>The main\nprayer, along with the relief being sought from the Apex Court, must also be clearly\nstated in the petition.<\/li><li>Further, the Interim\nrelief being sought along with the grounds for the same must also be stated.<\/li><li>Furthermore, a\nDECLARATION must also be affixed, declaring that there is no other petition\nseeking leave to appeal against the impugned order or judgment passed, and the\nannexures provided together with the SLP are true copies of the pleadings or documents\nwhich formed part of the records of the case.<\/li><li>The petition drafted\nmust be signed by an AOR (Advocate-on-Record).<\/li><li>The SLP drafted\nhas to be filed in the registry in seven copies, along with the appropriate\nfee.<\/li><li>The Apex Court\nthen decides if special leave can be granted or not in the particular case. <\/li><li>If in case the\nleave is granted, then the Supreme Court shall exercise its appellate\njurisdiction, and the resulting decisions will be binding.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><strong><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<div class=\"shadow3\">Special Leave\nPetition is a huge tool for the dispensation of justice from the Supreme Court\nin the country.&nbsp;However, the provisions relating to SLP are very fluid and\nflexible due to its inherent nature.
