Further, if a person leaves a Will for his property, then his estate will be distributed as per his wishes. Furthermore, in India, no law mandates Will Registration. However, a registered Will has more legal value than an unregistered one. In this article, we will be dealing with the procedure of obtaining <a href=\"https:\/\/lawyerinc.net\/in\/will-registration\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Will class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nterm Will has been defined under section 2 (h) of the Indian Succession Act,\n1925. According to the definition, a Will is a legal declaration of a person\u2019s\nintention regarding his property, which he wants to take effect after his\ndeath. In layman terms, a Will is basically a legal instrument. By way of a Will,\na person disposes of his estate. Further, the same is done in the name of his\nfriends, relatives, or any other person.<\/p>\n\n\n\n<p><div class=\"shadow3\">Usually,\nWill comes into effect after the death of the testatrix or testator (person\nmaking the will). Even though, in some cases, the transfer of the property takes\nplace during the life of the testator as well. Further, the validity of the Will\nis proved by the signature of the concerned testator and the attesting\nwitnesses of the said will. However, if there is a Probate of will, then the\nsame increases the credibility and reliability of the will.<\/div><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Types_of_Will\"><\/span><strong>Types of Will<\/strong><strong><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According to the India Succession\nAct, the term Will is bifurcated into two parts, i.e., Privileged Will and\nUnprivileged Will.<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Privileged Wills<\/strong> \u2013 These are those Wills that are drafted by the soldiers\nwho are employed in an expedition, mission, or a war-like situation or a\nmariner or airman. Further, these types of Wills can either be made orally or\nin writing, as these do not have many legal formalities.&nbsp;<\/li><li><strong>Unprivileged Wills<\/strong> \u2013 The term Unprivileged Wills deals with all other\nkinds of Wills. Further, the execution of these Wills required a lot of\nformalities starting from verification of signatures to attestation of\nwitnesses.&nbsp;<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_Eligibility_Criteria_for_drafting_a_Will\"><\/span><strong>What is the Eligibility Criteria for drafting a Will?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following listed are the eligibility criteria for drafting a Will &#8211;<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Testator must\nbe of 18 years;<\/li><li>Testator must have\na sound disposing mind or is able to take his own decisions;<\/li><li>Testator has\nmade the Will free from fraud, undue influence or coercion;<\/li><li>Testator must have full knowledge about the contents\nof the will<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Is_there_any_Specific_Format_prescribed_for_Drafting_a_Will\"><\/span><strong>Is there any Specific Format prescribed for Drafting a Will?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Although Will is a legal document, However, there is\nno such prescribed form of it as it can either be handwritten or typed on any paper\nand not just on the stamp paper. Further, a Will may be either altered or revoked\nby the owner at any time before his or her death.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_is_the_Executor_of_Will\"><\/span><strong>Who is the Executor of Will?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nexecutor of a Will is that person who will outline the entire process of Will\nRegistration and is appointed to make sure that the directions in the Will are\ncarried out according to the testator\u2019s wish. Further, an executor can be any\nperson or individual who is not a beneficiary as per the Will, or any trusted\nperson like a lawyer, family friend, or a chartered accountant.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_to_Make_a_Valid_Will\"><\/span><strong>How to Make a Valid Will?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following listed are\nthe point that are to be considered while making a Will \u2013<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>The Will made is required to be signed or affix mark by the testator in the presence of two or more witnesses,<\/li><li>The <a href=\"https:\/\/lawyerinc.net\/in\/will-drafting\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Will drafted (opens in a new tab)\">Will drafted<\/a> is then required to be attested by two or more witnesses;<\/li><li>The Will is not required to be witnessed by witnesses if in case an executor has been appointed who can now witness the same;<\/li><li>Will can easily be executed on plain paper itself. However, the use of Stamp Paper is entirely optional;<\/li><li>The Attestation or Notarization of the Will by the Notary Public or Oath Commissioner is again optional, and same depends on the will of the testator;<\/li><li>Even though in India, obtaining Registration of Will is optional and depends on to the will of a testator, however, it is always advisable and suggested to get it registered for increasing its legal authenticity;<\/li><li>The Will can be registered at the Sub-Registrar\u2019s office;<\/li><li>Further, obtaining Will Registration after death of the testator is possible as per Section 40 of the Indian Registration Act, 1908;<\/li><li>The revocation or alteration of the Will can be done as per the Indian Succession Act, 1925<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Is_it_Mandatory_to_obtain_Will_Registration_after_Death_of_Testator\"><\/span><strong>Is it Mandatory to obtain Will Registration after Death of\nTestator?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>One can proceed further\nwith an unregistered Will as Indian law does not mandate Will Registration.\nHowever, a registered Will has more legal value than an unregistered one.\nMoreover, one can obtain Will registration after death of the Testator.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_should_one_still_opt_for_the_Will_Registration_after_Death_of_Testator\"><\/span><strong>Why should one still opt for the Will Registration after Death\nof Testator?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following listed are the reasons as to why one\nshould opt Will registration after death \u2013 <\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>A\nregistered Will has a higher value in the eyes of the law.<\/li><li>If in\ncase the original Will gets lost or destroyed, a certified copy of the Will\nshall easily be obtained from the Registry at any time.<\/li><li>If in\ncase the original Will has tampered or any doubt arises, then a certified copy\nof the Will can easily be obtained from the Registry to compare both of them. <\/li><\/ol>\n\n\n\n<p><strong>Hence, it is in the best interest to get a will registered.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Advantages_of_obtaining_Will_Registration_after_Death_of_Testator\"><\/span><strong>What are the Advantages of obtaining Will Registration after Death of\nTestator?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following listed are\nthe advantages annexed with the concept of obtaining Will Registration after\nDeath of Testator\u2013 <\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Will is not damageable or destroyed\nor lost or stolen.<\/li><li>Will is kept in safe custody by\nthe Registrar.<\/li><li>No person can access or inspect\nthe Will without express written permission from the testator until his or her\ndeath.<\/li><li>If in case a registered Will is\nuncontested, then it is possible to get leasehold property mutated in the name\nof the legal heirs, that, too, without obtaining a will.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_Procedure_for_obtaining_Will_Registration_After_Death_of_Testator\"><\/span><strong>What is Procedure for obtaining Will\nRegistration After Death of Testator?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As we know, obtaining Will Registration after\ndeath of the testator is possible as per Section 40 of the Indian\nRegistration Act, 1908. The following listed are steps involved in the\nprocedure for obtaining Will Registration after Death of Testator \u2013 <\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Obtaining Will Registration after death of the\ntestator is possible only if it is signed by both the parties and is verified\nby witnesses. <\/li><li>Further, the claiming party is required to\nproduce the original Will before the Sub-Registrar Office, together with the\nTestator\u2019s Death Certificate. Moreover, the witnesses are also required to be\npresent before the Sub Registrar\u2019s office.<\/li><li>An affidavit\nis required to be filed by both the attesting witness before Sub-registrar to\nnotify that that the testator had executed his Will in their presence. Further,\nthey are also required to state that the testator was healthy and of sound mind\nat the time of execution. And lastly, that the testator had executed his Will\nof his own free consent.&nbsp;<\/li><li>If in case the officer is contended with the\ndocuments submitted and find them accurate then the Will can be registered.\nHowever, in the case of the testator\u2019s death, the officer can proceed further\nwith the \u201cWill Enquiry\u201d procedure.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><div class=\"shadow1\">Even though the concept of\nWill Registration is not mandatory in India, however the same is necessary for increasing\nits authenticity and value in the eyes of the law.
