class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Although section 482 of\nCrPC does not explicitly provide exactly what exactly comprises of the court&#8217;s\ninherent power of the court. However, this section authorizes the High Court\nwith broad, widespread powers in order to prevent injustices caused by\nsubordinate courts. Furthermore, the powers under this section are, although\nwide, but must be used only in exceptional circumstances.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_can_an_FIR_be_Quashed\"><\/span><strong>When can an FIR be\nQuashed?<\/strong><strong><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As per the Black Law Dictionary, the term Quash means\nto abate\/ to overthrow \/ to annul\/ to vacate \/ to make void. In layman terms,\nthe Quashing of FIR or Criminal Proceedings means ceasing the legal machinery\nto operate, which had been set in motion. This is normally done after an FIR\n(First Information Report) is filed, but before the final stage, filing of\nCharge Sheet stage.<\/p>\n\n\n\n<p>Further, the High Court\nshould cautiously use these powers to serve the ends of justice and prevent the\nabuse of the court process. If circumstances require, then only the court can\nuse its discretionary powers provided under Section 482.<\/p>\n\n\n\n<p>The Hon\u2019ble Supreme\nCourt had laid down detailed guidelines regarding this issue in its landmark\njudgment in <strong>Narinder Singh v. State of Punjab (2014).<\/strong><strong><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_termed_as_Compoundable_Offences\"><\/span><strong>What are termed as\nCompoundable Offences?<\/strong><strong><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>There are two types of\noffenses prescribed in the IPC, and these are compoundable and non-compoundable\ncases. Further, the offenses which are settled between the parties outside the\ncourt are termed as compoundable&nbsp;offenses<strong>.&nbsp;<\/strong>In\ncontrast, the offenses which are not permitted to be settled outside the court\nare termed as non-compoundable offences.<\/p>\n\n\n\n<p>Any person or individual\nagainst whom an FIR has been lodged for committing a non-compoundable offense can\napproach the court for the quashing of FIR. If, for some reasons that person\nbelieves he has been falsely and illegally implicated. <\/p>\n\n\n\n<p><em>Further, prima facie evidence must show that no case is made out against him or that some glaring irregularities that make it improbable for him to be convicted.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Need_to_implement_law_regarding_Quashing_of_FIR_or_Complaint\"><\/span><strong>Need to implement law regarding Quashing of FIR or Complaint?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The purpose behind the\nimplementation of law concerning the Quashing of FIR or Complaint is deterrence\nlimited by the considerations of justice. If there has to be forgiveness, mercy,\nand compassion in law, then the deterrent theory cannot prevail and thus widening\nthe scope of heinous crime against society. <\/p>\n\n\n\n<p>Further, the cases involving the\nscope of heinous crimes should have deterrence as a paramount purpose of\npunishment, and even if the family of the victim agrees to forgive the accused,\nthe law still needs to step in to deal strictly with the wrongdoers.<\/p>\n\n\n\n<p>However, some other offenses fall under\nthe \u201ccorrectional\u201d objective of the criminal court, and the punishment imposed must\nbe fair and conducive to them. The same is possible if the court thinks that\nthe settlement between the parties will lead to good and better relationships\nbetween them. Moreover, there is no other chance of relapse of any criminal\nencounters between the parties. <\/p>\n\n\n\n<p>Therefore, this section enables\nthe courts to restrict the public from filing fictitious, false and vexatious complaints\njust to satisfy their personal grudges.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_can_Quashing_of_FIR_be_done\"><\/span><strong>How can Quashing of FIR be done?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong>A petition for the quashing of FIR is always filed in the\nHigh Court. Further, <\/strong>the power of quashing an FIR vests with the high court by way\nof&nbsp;<strong>Section 320<\/strong>&nbsp;of the Indian\nPenal Code and&nbsp;<strong>section 482<\/strong>&nbsp;of the Code of Criminal\nProcedure. <\/p>\n\n\n\n<p><div class=\"shadow3\">Under Section 320, the\ncourt is directed to quash the order based on the compromise between the\nparties. The material or evidence on record guides section 482 as to whether\nthe end of justice will justify the exercise of such power or not. &nbsp;Further, under Section 482, the High Court\nhas the right to quash those criminal proceedings which are even not\ncompoundable. However, the said power must be used with caution. <\/div><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Factors_to_take_into_Consideration_while_Quashing_an_FIR_or_Complaint\"><\/span><strong>Factors to take into Consideration while Quashing an FIR or\nComplaint?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In the case of&nbsp;<strong>Gian Singh v. State of Punjab<\/strong>, the court had issued some\nguidelines that must be followed when the parties have reached a mutual\nsettlement and the petition for quashing order is made.&nbsp;<strong>The following\nlisted are the guidelines that are to be considered: <\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Justice is served to the\naggrieved.<\/li><li>Process of the concerned court is\nnot abused in any manner.<\/li><li>This power granted to the High\nCourt cannot be used in case of heinous and serious crimes like rape, dowry,\nmurder, or any other offense committed under any special statutes like the\nPrevention of Corruption Act or any other offense committed by the public\nservant which is not qualified to be quashed by mutual compromise.<\/li><li>Cases arising out of matrimonial\ndisputes or commercial transactions must be quashed only when justice is done.<\/li><li>A court should also see that the\naggrieved person is not put into extreme injustice and depression by not\nquashing the criminal cases.<\/li><li>Offenses committed under section\n307 are not only heinous but are considered as crimes against society. However,\nit would be open to approach the court by the nature of the injury. The court\ncan also move further by the fact that the parties&#8217; settlement is going to\nensue in harmony.<\/li><li>While deciding cases under&nbsp;section\n482,&nbsp;timings play a crucial role. In cases where an immediate settlement\nis done, FIR can easily be quashed because, in such cases, filing of charge\nsheets is not done yet. However, in cases where the investigation stage is\nalmost complete, and the conclusion is at the argument\u2019s stage, the court must\nrefrain from using its power provided under&nbsp;section 482. As&nbsp;in such\ncases, the case can easily be decided easily based on merits.<\/li><\/ol>\n\n\n\n<ul class=\"wp-block-list\"><li><strong><a rel=\"noreferrer noopener\" aria-label=\"All You Need to Know About E-FIR in India               (opens in a new tab)\" href=\"https:\/\/lawyerinc.net\/learning\/all-you-need-to-know-about-e-fir-in-india\/\" target=\"_blank\">All You Need to Know About E-FIR in India<\/a><\/strong><\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Supreme_Courts_Power_to_Quash_an_FIR_or_Complaint\"><\/span><strong>Supreme Court\u2019s Power to Quash an FIR or Complaint<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>If\nthe High Court rejects or denies the petition filed, the petitioner can then\nfile a Special Leave Petition (SLP) to the Apex Court under Article 136 of\nIndia&#8217;s Constitution.<\/p>\n\n\n\n<p>Further,\nthe Supreme Court also has the inherent power to deal with such matters. Moreover,\nthe same guidelines are to be followed, which were provided by the high court\nin the case \u2018<strong>Gian Singh v. State of Punjab.<\/strong>\u2019<\/p>\n\n\n\n<p>Further, the Apex Court\nin the case \u2018<strong>Nikhil\nMerchant vs. Central Bureau of Investigation and another (2008) 9 SCC 677<\/strong>, held that technicality\nmust not cause any interruption in the process of criminal proceedings because\nthe continuation of the same offense even after compromise have arrived between\nthe parties would be a futile exercise.<\/p>\n\n\n\n<p>Also, any FIR filed against\na person can be quashed if the same did not prima facie disclose any offense.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The laws have been made to ensure\nthat no one is suppressing anyone\u2019s right, and if in case someone is doing it,\nthen he or she shall be punished. However, there are several cases in which a\nperson makes use of these provided laws which are favoring him to trouble the\ninnocent people.<\/p>\n\n\n\n<p><div class=\"shadow2\">So, to tackle this, the issue\nlawmakers have provided the High Court the power of Quashing of FIR if they are\nsatisfied that the same was lodged with the motive to trouble the person.
