Under the Constitution of India, 1950, article 161 and article 72 authorize the Governor as well as the President to suspend, grant pardon, commute, or remit the sentence. Meanwhile, in the Code of Criminal Procedure, 1973, there is a whole chapter dedicated to the commutation, remission, and suspension of sentence. It is an act of keeping the sentence in suspension\nby the court. It is done to allow the accused to file an appeal in the\nappellate court. However, if the court thinks so, it can also order re-arrest\nof the offender and direct him to undergo the remaining sentence without giving\nany reason. The same is reiterated in the 41<sup>st<\/sup> Law Commission Report,\nPage 281 Para 29.1; and also, in the cases, such as <strong><em>\u2018Ashok Kumar v. Union\nof India, AIR 1991 SC 1792\u2019, \u2018State of Punjab v. Joginder Singh, AIR 1990 SC\n1396\u2019.<\/em><\/strong><\/p>\n\n\n\n<p>Further, section 389(1) and (2) of the Code of\nCriminal Procedure, 1973, deals with a condition, where an accused person can\nget a Bail from the appellate court after filing the criminal appeal. In\ncontrast, section 389(3) deals with a condition where the trial court itself\ncan grant bail to the accused permitting him to file an appeal. However, we are\nconcerned with the authority of the trial court to suspend the sentence, so, section\n389 (3) will be taken into account.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Applicability_of_Section_3891_of_CrPC\"><\/span><strong>Applicability of Section 389(1) of CrPC<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According to section 389(1), the\nappellate court can use its power to release on bail, on if the following\nconditions are met:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>The person requesting for bail is an accused person;<\/li><li>His appeal against the conviction is pending.<\/li><\/ol>\n\n\n\n<p><div class=\"shadow3\">However, before\ngranting such bail, the appellate court is required to record its reasons in\nwriting. The appellate court may also order that the execution of the said sentence\nor order be suspended. Moreover, if a person is in confinement, the appellate\ncourt can also pass an order to release such a person on \u2018bail\u2019 or on \u2018his own\nbond\u2019.<\/div><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Applicability_of_Section_3893_of_CrPC\"><\/span><strong>Applicability of Section 389(3) of CrPC<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following listed are the points that deal with the\napplicability of section 389(3): <\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>The&nbsp;Court\nshall be&nbsp;the&nbsp;convicting&nbsp;Court;&nbsp;&nbsp;<\/li><li>The&nbsp;accused&nbsp;ought\nto&nbsp;be&nbsp;convicted&nbsp;by&nbsp;the respective&nbsp;Court;&nbsp;&nbsp;<\/li><li>The accused shall\nbe sentenced to imprisonment for a period not more than three years;<\/li><li>The&nbsp;accused&nbsp;must&nbsp;express&nbsp;his&nbsp;intention&nbsp;to&nbsp;file\nan&nbsp;appeal&nbsp;before the&nbsp;appellate&nbsp;Court;&nbsp;<\/li><li>On the date of\njudgment, the&nbsp;accused shall&nbsp;be&nbsp;on&nbsp;bail;<\/li><li>The right to\nappeal must be granted. The same was reiterated by the Hon\u2019ble Supreme Court in\nthe case, <em>\u2018<strong>Mayuram Subramanian Srinivasan v. C.B.I, (2006) 5 SCC 752\u2019.<\/strong><\/em><\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Power_of_Trial_Court_as_per_Section_3893_of_CrPC\"><\/span><strong>Power of Trial Court as per Section 389(3) of CrPC<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The powers granted to the trial court by way of\nsection 389(3) are listed below:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>The Trial&nbsp;Court&nbsp;has&nbsp;the\npower&nbsp;to&nbsp;grant bail to the accused.<\/li><li>The Trial&nbsp;Court&nbsp;has&nbsp;the\npower&nbsp;to&nbsp;reject&nbsp;the&nbsp;bail&nbsp;if&nbsp;in case there&nbsp;are&nbsp;some\n\u2018special reasons.&nbsp;<\/li><li>The Trial Court\nhas the power to release such accused for a period that will allow him with\nsufficient time to file an appeal in the appellate court. <\/li><\/ol>\n\n\n\n<p>After that, it is provided that, the sentence of\nimprisonment will be considered suspended till the time accused is on bail. So,\nit shall be pertinent to take into consideration that the trial court is first\nrequired to decide whether it should grant bail or not. Secondly, whether there\nare any special reasons for refusing the bail. If in the case, the respective Court\ndoes not find any \u2018special reason\u2019 for rejecting the bail, the accused has to mandatorily\nbe released on bail for allowing him to file an appeal to the appellate Court.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Features_of_Section_3893_of_CrPC\"><\/span><strong>Features of Section 389(3) of CrPC<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following are the features of section 389(3) of the\nCode of Criminal Procedure, 1973:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>The accused will\nnot be released on bail \u2018as of right\u2019 directly. However, he needs to convince\nthe court that he is \u2018eligible\u2019 to be released on bail.<\/li><li>If the respective\ntrial Court is convinced that there are some \u2018special reasons\u2019 for not granting\nbail to the accused, then the said Trial Court can very well do.<\/li><li>The only motive of\nthis subsection is to allow the accused to file an appeal to the Appellate\nCourt.<\/li><li>No&nbsp;maximum&nbsp;period&nbsp;is&nbsp;specified&nbsp;for&nbsp;granting\nbail to the accused. <\/li><li>According to this\nsubsection, suspension&nbsp;of&nbsp;sentence&nbsp;is&nbsp;\u2018deemed\u2019 suspension.<\/li><li>Suspension\nof&nbsp;sentence&nbsp;is&nbsp;a by-product of the convict&nbsp;being\nreleased&nbsp;on&nbsp;bail.<\/li><li>The trial Court\nhas no authority to firstly, order suspension of sentence and then release the\naccused on bail.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Difference_in_the_Operation_of_section_3891_and_3893_of_CrPC\"><\/span><strong>Difference in the Operation of section 389(1) and 389(3) of\nCrPC<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<table class=\"wp-block-table\"><tbody><tr><td>\n  <strong>Section 389(1)\n  of CrPC<\/strong>\n  <\/td><td>\n  <strong>Section 389(3)\n  of CrPC<\/strong>\n  <\/td><\/tr><tr><td>\n  Subsection (1)\n  comes into the role when an appeal is pending.\n  <\/td><td>\n  Subsection (3)\n  comes into the role when the accused expresses his desire to file an appeal.\n  <\/td><\/tr><tr><td>\n  Sub\u00adsection (1)\n  firstly, deals with the \u2018suspension,\u2019 and then talks about the \u2018release on\n  bail\u2019 or \u2018own bond.\u2019\n  <\/td><td>\n  Subsection (3) firstly,\n  deals with the \u2018release&nbsp;&nbsp; on&nbsp;&nbsp; bail,\u2019 and then \u2018suspension.\u2019 Lastly, it\n  deals with the \u2018automatic\u2019 effect.\n  <\/td><\/tr><tr><td>\n  Subsection (1)\n  does not specify that the accused should be on bail.\n  <\/td><td>\n  Subsection (3)\n  can be used only if, on the date of judgment, the said accused is on bail.\n  <\/td><\/tr><tr><td>\n  Subsection (1) provides\n  an option to release the accused either on \u2018bail\u2019 or \u2018own bond.\u2019\n  <\/td><td>\n  Trial Court by\n  way of Subsection (3) does not have the power to release the accused on \u2018own bond.\u2019\n  However, the trial Court can release an accused on his own bond, if in case the\n  accused is poor, etc.\n  <\/td><\/tr><tr><td>\n  In nutshell, by\n  way of subsection (1), suspension acts as cause and bail as its effect.\n  <\/td><td>\n  In the case of,\n  subsection (3), bail acts as cause and suspension as its effect.\n  <\/td><\/tr><\/tbody><\/table>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nconcept of suspension of sentence can either be conditional or unconditional.\nAn unconditional suspension of sentence simply means a sentence is suspended with\nno prior stipulations attached. However, in the case of the conditional suspension\nof sentence, the judge can refrain from executing a punishment for the period\nthe accused satisfies the stipulation of the suspension.
