Seeking this kind of divorce will decrease the trouble and pressure faced by spouses as compared to other procedure of dissolution of marriage. With an increase in the number of cases in Courts of India other ways for obtaining a divorce is time taking and creates lots of inconveniences, hence mutual divorce is hassle free and easy. However, it is essential for both parties to make sure that all the required conditions are fulfilled, such as both the parties agreed to the conditions without any disagreement and force.&nbsp; <\/p>\n\n\n\n<p>Duration\nfor obtaining a divorce under mutual consent is 6months. class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Divorce by mutual consent can be withdrawn by filing a petition before the Court stating that either of the parties does not wish to seek <a href=\"https:\/\/lawyerinc.net\/in\/mutual-divorce\">divorce <\/a><a href=\"https:\/\/lawyerinc.net\/in\/mutual-divorce\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"under (opens in a new tab)\">under<\/a><a href=\"https:\/\/lawyerinc.net\/in\/mutual-divorce\"> mutual consent<\/a>. In that case, the Court grants no divorce decree.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conditions_essential_for_mutual_consent\"><\/span><strong>Conditions essential for mutual consent<\/strong>\n:-<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ol class=\"wp-block-list\"><li>Parties are living separately for a period of not less\nthan one year.<\/li><li>No reconciliation or adjustments are possible between\nthem<\/li><li>Parties have given free consent to the agreement of\ndissolution of marriage<\/li><li>The parties are at liberty to withdraw the petition.<\/li><\/ol>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Petition_for_divorce_by_mutual_consent\"><\/span><strong>Petition for divorce by mutual consent<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>The petition for <a href=\"https:\/\/lawyerinc.net\/in\/mutual-divorce\">divorce by mutual <\/a><a href=\"https:\/\/lawyerinc.net\/in\/mutual-divorce\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"consent (opens in a new tab)\">consent<\/a> can be filed at the following places-<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Place of marriage,<\/li><li>Where husband and wife last resided together,<\/li><li>Place where the wife resides\/stays at the time of filing of the petition.<\/li><\/ol>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/lawyerinc.net\/learning\/wp-content\/uploads\/2019\/06\/divorce-3195578_960_720.jpg\" alt=\"Divorce by mutual consent\" class=\"wp-image-364\" width=\"417\" height=\"341\" srcset=\"https:\/\/lawyerinc.net\/learning\/wp-content\/uploads\/2019\/06\/divorce-3195578_960_720.jpg 881w, https:\/\/lawyerinc.net\/learning\/wp-content\/uploads\/2019\/06\/divorce-3195578_960_720-300x245.jpg 300w, https:\/\/lawyerinc.net\/learning\/wp-content\/uploads\/2019\/06\/divorce-3195578_960_720-768x628.jpg 768w\" sizes=\"auto, (max-width: 417px) 100vw, 417px\" \/><\/figure><\/div>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_for_divorce_by_mutual_consent\"><\/span><strong>Procedure for divorce by mutual consent<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p> The petition for <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/lawyerinc.net\/in\/mutual-divorce\" target=\"_blank\">divorce by mutual consent<\/a> must be filed by both the parties is in the form of an affidavit, which is to be submitted to the family court. Once the petition is filed, both the parties need to be present before the Hon\u2019ble Court and record the statement. In the first motion, the Court generally adjourns the matter for a period of 6 months, which is termed as cooling off period between the parties, the time has been provided by the Court for reconciliation between the parties and solves the dispute. &nbsp;After six months, the parties have to be present again before the Court for making a second motion confirming the mutual consent filed earlier. This is mandatory and it is only after this second motion that a decree of the divorce by mutual consent is granted by the Court.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><a href=\"https:\/\/lawyerinc.net\/in\/mutual-divorce\" target=\"_blank\" rel=\"noreferrer noopener\"><img loading=\"lazy\" decoding=\"async\" width=\"728\" height=\"90\" src=\"https:\/\/lawyerinc.net\/learning\/wp-content\/uploads\/2019\/07\/Divorce-Notice.jpg\" alt=\"Divorce by Mutual Consent\" class=\"wp-image-768\" srcset=\"https:\/\/lawyerinc.net\/learning\/wp-content\/uploads\/2019\/07\/Divorce-Notice.jpg 728w, https:\/\/lawyerinc.net\/learning\/wp-content\/uploads\/2019\/07\/Divorce-Notice-300x37.jpg 300w\" sizes=\"auto, (max-width: 728px) 100vw, 728px\" \/><\/a><\/figure>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Is_the_cooling_off_period_in_divorce_by_mutual_consent_mandatory\"><\/span><strong>Is the cooling off period in divorce by mutual consent mandatory?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>&nbsp;The cooling off period of six months is not\nmandatory. If at all the Hon\u2019ble Court thinks fit, then it can waive off the\ncooling period. The parties who seek to divorce by mutual consent can request\nthe Court to waive off the cooling period and not wait for another six months\nand proceed with the second motion as their decision is final and no scope of\nreconciliation is left. &nbsp;<\/p>\n\n\n\n<p>Hence,\nin order to save the marriage, the Hon&#8217;ble Courts give six months as cooling\noff period if there is a chance of reconciliation in the future and in these\nsix months the Court asks the parties to follow the arbitration procedure. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"_Maintenance_in_case_Divorce_by_Mutual_Consent\"><\/span><strong>&nbsp;Maintenance in case\nDivorce by Mutual Consent&nbsp; <\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>In cases of mutual divorce, there is a requirement that the spouses have to mutually agree on the amount of maintenance, which will be provided by the husband to wife or vice-versa. The parties can mutually declare stating there is no requirement to pay any kind of maintenance.  Following factors are taken into consideration for the amount of maintenance to be paid by either of the parties-<\/p>\n\n\n\n<p>-The financial position of either\nof the spouse,<\/p>\n\n\n\n<p>-Child custody,<\/p>\n\n\n\n<p>-Duration of marriage,<\/p>\n\n\n\n<p>-The health of the spouse, etc\u00a0 <br><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mutual_Divorce_under_Muslim_Law\"><\/span><strong>Mutual Divorce under Muslim Law<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>Under\nMuslim Law, there are two kinds of divorce by a mutual agreement called \u2018khula&#8217;\nand \u2018mubarat.&#8217; Divorce is a decision taken by the parties, and no interference\nby the Court is required. In both \u2018Khula\u2019 and \u2018mubarat\u2019 the wife shall go through\nthe \u2018iddat\u2019 period.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mutual_Divorce_under_Christian_Law\"><\/span><strong>Mutual Divorce under Christian Law<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>Under the <a href=\"https:\/\/indiacode.nic.in\/handle\/123456789\/2280?view_type=browse&amp;sam_handle=123456789\/1362\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Divorce Act, 1869<\/a>, section 10A of the Act gives the provision for dissolution of marriage by mutual consent. A condition required for divorce by mutual consent under Christian law \u2013 No scope of cohabitation again in the future, parties living separately for more than one year and the parties agreed upon the dissolution of marriage mutually.&nbsp; <\/p>\n\n\n\n<p>A petition for mutual divorce can be presented by both the\nparties to the appropriate district court. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mutual_Divorce_under_Parsi_Law\"><\/span><strong>Mutual Divorce under Parsi Law<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>&nbsp;Under the Parsi\nMarriage and Divorce Act, 1936, section 32B provides Divorce by Mutual Consent.\nA Condition essential for divorce by mutual consent under Parsi Law- <\/p>\n\n\n\n<p>Both&nbsp; the parties\nliving separately for a period of not less than one year or more, and<\/p>\n\n\n\n<p>Both the parties mutually agreed upon the decision for\ndissolution of marriage. Therefore, the petition for divorce by mutual consent\nunder Parsi Law cannot be filled within one year since the date of marriage. &nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p><a href=\"https:\/\/lawyerinc.net\/in\/mutual-divorce\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Divorce under mutual consent<\/a> is the fastest way to obtain a divorce and dissolved the marriage with utmost dignity without any quarrel.
