Thereafter, the trademark owner has the right to file suit and collect money damages for the wrongful use.<\/p>\n\n\n\n<p>The infringement of trademark cases will only succeed if there is a likelihood of any confusion. Additionally, if the marks are similar enough to mislead customers and they share the same market, it will come under trademark infringement. <\/p>\n\n\n\n<p>Above all, Trademark represents the brand. This is why we should ensure there is no infringement as it causes loss of finances to the owner of the Trademark. It is always better to take precautions and be vigilant and protect our trademark.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Trademark_Infringement_under_Indian_Law\"><\/span><strong>Trademark Infringement under Indian Law<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><a href=\"http:\/\/www.ipindia.nic.in\/writereaddata\/Portal\/IPOAct\/1_43_1_trade-marks-act.pdf\">The Trademark Act, 1999<\/a> talks about trademark infringement in section 29.  An unauthorized use of an identical or deceptively similar trademark for similar goods and service is trademark infringement.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Circumstances_under_which_Trademark_Infringement_occurs\"><\/span><strong>Circumstances under which Trademark\nInfringement occurs<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Situations under which there is trademark infringement-<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>If the mark is identical or deceptively similar and dealing with similar services or goods.<\/li><li>Moreover, if similar marks confuse the customers.<\/li><li>If the similarity of the trademark causes unfair advantage or harms the reputation of the registered trademark.<\/li><li>Finally, if there is the usage of similar packaging or labelling without due authorization.<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_burden_of_proof_of_trademark_infringement\"><\/span><strong>The burden of proof of trademark infringement<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>The Supreme Court in <em><strong>Kaviraj Pandit Durga Dutt Sharma v. Navratna Pharmaceutical Laboratories<\/strong> <\/em>held that the burden of proof for trademark infringement is on the plaintiff. Furthermore, the Plaintiff has to establish that the trademark used by the defendant is deceptively similar to the trademark of the plaintiff dealing with similar goods for which they are already registered.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Method_to_establish_similarity_between_two_trademarks\"><\/span><strong>Method to establish similarity between two trademarks<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>In <em><strong>Atlas Cycle Industries Ltd. v. Hind Cycles Limited<\/strong><\/em>, the Delhi High Court extensively decided on the question of how will the plaintiff establish that the defendant&#8217;s mark is identical or resembles the plaintiffs.<\/p>\n\n\n\n<p>The Court additionally stated that, in matters of trademark infringement, the plaintiff is entitled to establish that the trademark is identical and resembles the trademark of the plaintiff and it could deceive the customers and cause confusion.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Jurisdiction_for_instituting_a_suit_for_Trademark_Infringement\"><\/span><strong>Jurisdiction for instituting a suit for Trademark Infringement<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>Section 134 of the Trademarks Act, 1999 provides the jurisdiction for filing a suit for infringement. We can file suit in the District Court within within which we reside or carry our business or personally work for gain. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Prescribed_Punishment_for_Trademark_Infringement\"><\/span><strong>Prescribed\nPunishment for Trademark Infringement<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<ul class=\"wp-block-list\"><li>Section 103 of the Trademark Infringement Act, 1999 states the punishment for falsification of the trademark. Punishment should not be from six months to three years and with a fine between fifty thousand rupees to two lakh rupees.<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Effect_of_Trademark_Infringement\"><\/span><strong>Effect\nof Trademark Infringement<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>The person infringing the trademark may take undue advantage\nof the hard-earned reputation of the trademark which is registered.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Remedies_available_for_Trademark_Infringement\"><\/span><strong>Remedies available for\nTrademark Infringement<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<ul class=\"wp-block-list\"><li>Civil and criminal remedy is available. <\/li><li>It is a cognizable offence under the Trademark Act, 1999. Police complaint can be filed in this, and the Courts are empowered to <em>suo moto <\/em>conduct raids and seizure operations.<\/li><\/ul>\n\n\n\n<p>As per the Limitation Act, 1963, the period for limitation is three years from the infringement. But as a matter of fact there is no time limit prescribed if the infringement is a continuing offence as new cause of action arises every time infringement occurs.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Trademark_Infringement_Remedies\"><\/span><strong>Trademark Infringement Remedies <\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<div class=\"row row-eq-height\">\n    <div class=\"col-sm-6 mt-12\">\n        <div class=\"box1\">\n            <div class=\"box-text1\">\n              <p>Injunction\/stay against the use of trade mark<\/p>\n    \n            <\/div>\n         <\/div>\n\t<\/div>\n\t\t\t\n\t<div class=\"col-sm-6 mt-12\">\n\t\t<div class=\"box1\">\n            <div class=\"box-text1\">\n             <p>Appropriate Damages<\/p>\n            <\/div>\n        <\/div>\n\t<\/div>\n\t\n\t<div class=\"col-sm-6 mt-12\">\n\t\t<div class=\"box1\">\n            <div class=\"box-text1\">\n\t          <p>Handing Over of accounts and profits<\/p>\n            <\/div>\n\t     \n\t\t<\/div>\n    <\/div>\n\t<div class=\"col-sm-6 mt-12\">\n\t\t<div class=\"box1\">\n            <div class=\"box-text\">\n\t          <p>Appointment of a local Commissioner by the Court for custody\/sealing of infringing material and accounts. The court can grant injunctions and direct the custom authorities to withhold the infringing material<\/p>\n            <\/div>\n\t     \n\t\t<\/div>\n    <\/div>\n\t<div class=\"col-sm-6 mt-12\">\n\t\t<div class=\"box1\">\n            <div class=\"box-text2\">\n\t          <p>An application under Order 39 rule 1 &amp; 2 of CPC for grant of temporary or ad interim ex-parte injunction. Interim orders are generally ex-parte or after notice.<\/p>\n           \n\t     <\/div>\n\t\t<\/div>\n    <\/div>\n           \t\n            \n   \n   <\/div>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conditions_where_there_is_no_Trademark_Infringement\"><\/span><strong>Conditions\nwhere there is no Trademark Infringement<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>Section 30 of the Trademark Act, 1999 state about situations which don\u2019t amount to <a href=\"https:\/\/lawyerinc.net\/in\/quashing-of-fir\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"trademark infringement (opens in a new tab)\">trademark infringement<\/a>. <\/p>\n\n\n\n<p>Further, it states if one uses the trademark diligently, usage is outside the scope of registration, or the trademark is not used for undue advantage, or if there is an implied consent by the original proprietor for the usage then we cannot say that it is infringement.<\/p>\n\n\n\n<p>Besides the conditions which don\u2019t fall under trademark infringement are as follows-<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>If the usage is outside the scope of registration.<\/li><li>If there is implied consent by the original proprietor for the usage.<\/li><li>Use of a trademark in relation to the parts and accessories.<\/li><li>Usage of an identical or similar trademark.<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Passing_Off\"><\/span><strong>Passing\nOff<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>The concept of passing off has emerged in the recent past to protect the unregistered trademark. It prevents people from misrepresenting its goods and services from the other parties. <\/p>\n\n\n\n<p>There are three ingredients of passing off popularly known as the classical trinity. These include Reputation, Misrepresentation and damage to goodwill. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Characteristics_of_passing_off\"><\/span>Characteristics of\npassing off<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>The Court looks into Passing off case.Additionally, the Court looks into the issue of nature of mark and goods, degree of resemblance misrepresentation, similarities in nature etc.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Misrepresentation<\/li><li>Harming business and goodwill of other\nperson<\/li><li>To attract prospective consumers<\/li><li>It causes actual damage to the original\nproprietor <\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>With technological advancement, the need to protect our intellectual property is a must.
