What is Authorization?

"Authorization" means permission granted by the prescribed authority for the generation, collection, reception, storage, transportation, treatment, processing, disposal or any other form of handling of bio-medical waste in accordance with these rules and guidelines issued by the Central Government or Central Pollution Control Board as the case may be.

With a boom in the information and communication sector, there has been an enormous change in our economies and industries. To address this issue, the Ministry of Environment and Forests came up with E-Waste (Management and Handling) Rules, 2011. It discusses the liabilities of the producers, methods to reduce e-waste. These also will give us an opportunity to turn a problem into a development opportunity.

What is e-waste?

With exponential growth in the industrial sector, we see e-waste as a growing waste stream. E-waste is considered as dangerous to our society because they contain toxic elements like lead, cadmium, lead oxide (in cathode ray tubes), noxious gases, toxic metals, biologically active materials, acids, plastics and plastic additives. As they are considered hazardous, their disposal is vital for the preservation of society

E-Waste (Management and Handling) Rules apply to every manufacturer, producers, refurbisher, consumers, dealers and recyclers etc. who are involved in the manufacture, sale, transfer, processing and storage of the e-waste listed under Schedule I, but it does not include the following-

  • Used acid batteries
  • Micro enterprises
  • Radio-active wastes

Chapter III of the Rules states the procedure for seeking authorization and registration for handling e-waste.

Documents for E-Waste Authorization

Following are the documents required for e-waste authorization-

  • Name and address

Hazardous Waste Authorization (HWM)

The Hazardous Waste (Management & Handling Rules, 1989, were notified by the government for the collection, safe handling, treatments, storage, conversion, sale, destruction and disposal of hazardous waste.

These rules talk about the duties and powers of various authorities such as MoEF, CPCB, State/UT Govts., SPCBs/PCCs, DGFT, Port Authority and Custom Authority. The State Pollution Boards or committees have been given more extensive responsibilities touching every aspect related to hazardous wastes generation, handling and their disposal.

Documents required for authorization for handling Hazardous Wastes

Following documents are required for Hazardous Waste Authorization-

  • Form No. 1
  • Form No. 10
  • Industry Data Sheet.
  • Consent to Operate/Renewal under Water Act, 1974 and Air Act, 1981.
  • Duplicate Copy of Previous Hazardous Waste Authorization issued by PCC, DD & DNH.
  • Process Flow Chart.
  • For disposal of hazardous waste, TSDF Membership certificate.
  • Mode of disposal of hazardous waste along with details of recycler/re-processor or actual users.

Under the Hazardous & Other Wastes (Management and Trans boundary Movement) Rules, 2016 Rule 4, the occupier is the one who is responsible for safe and environmentally sound management of hazardous and other wastes which are generated in the establishment to be sent to the authorized actual used or shall be disposed of in an authorized disposal facility.

Under the Hazardous & Other Wastes (Management and Trans boundary Movement) Rules, 2016, Rule 6, every occupier of the facility who is responsible for the handling, collection, storage, treatment, recovery, and transfer of the hazardous waste is required to obtain an authorization from the DPCC.

Prerequisites required for obtaining authorization for storage under Hazardous Waste Rules

  • The display of updated date on the main factory gate
  • Appropriate containment system in the storage facility.
  • The containers or enclosures should be marked Hazardous Waste in red or Hindi/English.
  • The occupier has the duty to take precautions for prevention from any accidental ignition or reaction of ignitable or reactive waste.
  • The containment system should be leak proof and able to drain/remove liquids.
  • Units storing hazardous waste should store the waste in such manner that it does not contaminate the environment.

Bio-Medical Waste (BMW) Authorization

Any waste generated during the diagnosis, treatment and immunization of human being or animals or generated during the research activities, production or testing of biological camps is termed as biomedical waste. For example, patient's blood, infected parts, biological liquids like chemicals, medicines, etc. It includes all the waste which is generated from the Health Care Facility which if not appropriately disposed will have an adverse effect on the environment and people as well.

All such waste was covered under the Bio-medical Waste Management Rules, 2016 (BMWM Rules).

Bio-Medical Waste Authorization is necessary for the generation, collection, reception, storage, transportation, treatment, disposal or any other manner of handling of biomedical wastes listed in Schedule 1 of the Bio-medical Wastes Management Rules, 2016.

These rules categorize the bio-medical waste generated from the health care facility into four major groups on the basis of segregation pathway and a colour code. Many types of bio- medical waste come under each of these categories. Following is the segregated category-

  • Yellow Category
  • Red Category
  • White category
  • Blue Category

Bio-Medical Waste Management

The Bio-medical Waste Management Rules, 2016 apply to people/entities which are involved in the generation, collection, storage, transport, treatment, disposal, or handling of bio medical waste in any form comprising of hospitals, nursing homes, clinics, dispensaries, veterinary institutions, animal houses, blood banks, Ayush hospitals, research or educational institutions, health and medical or surgical camps, vaccination camps, blood donation camps, forensic laboratories and research labs, etc.

The State Pollution Control Board or Pollution Control Committee is the authority which helps in the enforcement of the rules in the State in matters of health care establishments. In the case of health care establishment of the Armed Forces the Director General, Armed Forces Medical Services has the authority to deal with enforcement of such rules.

These rules stipulate the liabilities of the occupier/operator of the Bio-Medical waste Treatment facility as well as identified authorities. According to these rules, one needs to have an authorization from the prescribed authority as the case may be.

Who needs authorization?

The Bio-medical Waste Management Rules, 2016, under section 10 states that every occupier/operator is required to have an authorization if they are dealing with bio-medical waste, irrespective of the quantity.

Application Procedure for Bio-Medical Waste Authorization

  • Applications can be filed online
  • After submission of application online, submit hardcopy to the concerned office with challan showing payment of fees along with forwarding letter
  • Both the forwarding letter and form needs to be signed by the occupier.

Documents Required for Bio-Medical Waste (BMW) Authorization for Health Care Units/Combined Bio-Medical Waste Treatment Facility

  • An application form, in prescribed format [Form-I]
  • Particulars of Applicant
  • Duly attested undertaking in a prescribed format
  • Activity for which authorization is sought like generation, collection, storage, processing or recycling etc.
  • Application for fresh or renewal of authorization
  • Address of the health care facility (HCF) or common bio-medical waste treatment facility (CBWTF)
  • GPS coordinates of HCF or CBWTF
  • Details of HCF or CBWTF for example month and year of establishment, number of beds, installed treatment and disposal capacity of the CBWTF, the quantity of the bio-medical waste handled, treated or disposed of, description of arrangements for handling BMW etc.
  • Prescribed fee for a minimum period of 3 years through DD in favour of DPCC.
