Plastics Waste Management

The Plastic Waste (Management and Handling) rules define Plastics as “a material which contains essential ingredient a high polymer such as polyethylene terephthalate, high-density polyethylene, Vinyl, low-density polyethylene, polypropylene, polystyrene resins, materials like acrylonitrile butadiene styrene, polyphenylene oxide, polycarbonate, and Polybutylene terephthalate.”

It further states that a Plastic waste is any plastic is discarded after the use is over.

Rules governing Plastics Waste Management

Plastic Waste (Management and Handling) Rules, 2011

  • These rules are applicable to every waste generator, local bodies, Gram Panchayat, manufacturer, importers, and producers.
  • These rules lay out the responsibilities of the local body. It states that the local body is responsible for the overall development and setting up of the infrastructure for the segregation, collection, storage, transportation, processing and disposal of the plastic waste either by itself or through an agency.
  • Every Gram Panchayat has to set up, operationalize, and co-ordinate for waste management.
  • The rules further state that the waste generators have to minimize the generation of plastic waste and segregate the waste at the source only.
  • The producers have to plan out the waste collection systems based on Extended Producers Responsibility.

Key highlights of 2018 Amendment

  • The 2018 amended rules prescribe a central registration system for the registration of Producers, importers and brand owner. It further lays down the mechanism for registration.
  • National Registry was prescribed for the producers with a presence in more than two states.
  • The amended rules prescribed a state level registration for small producer and brand owner operating within one or two states.
  • All the registration mechanism should be automated.

Delhi Degradable Plastic Bag (Manufacture, Sale, and Usage) and Garbage (Control) Act, 2000

This act prevents the contamination of foodstuff carried in recycled plastic bags, reduce the usage of plastic bags, and throwing or depositing non-biodegradable garbage in places like public drains, rivers, roads, and places which are open to the public view in Delhi NCR.

Who needs a Plastics Waste Management Authorization?

The Producers, recyclers, and manufacturers need a plastic waste management authorization.

Application Procedure for Registration

  • Every producer has to make an application in Form I for registration or renewal of registration to the Concerned State Pollution Control Board (SPCB) or Pollution Control Committee (PCC), Central Pollution Control Board.
  • People involved in recycling and processing of waste or processing plastic or recycle plastic waste have to make an application under SPCB or PCC for recycling unit in Form II.
  • The producers shall apply to the Pollution Control Board or the Pollution Control Committee for the grant of registration or renewal in Form III.
  • Every manufacturer of plastic which is to be used as raw materials have to make an application to the SPCB or PCC in Form III.
  • The SPCB or PCC shall not issue or renew a registration if the plastic waste recycling or processing units don't possess a valid consent from the Waster (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981
  • The SPCB or PCC shall not renew the registration of the producers unless the producer possesses an action plan for setting up a plastic waste management system.
  • After the application procedure is complete, the SPCB may after inquiry grant registration.
  • Registration has to be granted within 90 days of the completed application.
  • The registration will be valid for one year unless it is revoked, suspended or cancelled and granted for three years.
  • Every renewal application has to be made at least 120 days before the expiry of registration validity.

Authorization from the Delhi Pollution Control Committee

1. A person manufacturing degradable plastic bag has to apply in the prescribed form with the requisite fees to the Delhi Pollution Control Committee (DPCC) for authorization.

2. The DPCC may grant the authorization if-

  • The recycled bag is colored and pigmented, and dyes used in manufacturing plastics bags shall be in accordance with the pigments & dyes as listed in IS 9833: 1981.
  • The process of recycling and reprocessing is undertaken in accordance with IS 14534: 1998 titled "Guidelines for recycling of plastic" and shall be further marked as-

    (i) degradable, recycled plastic bags,

    (ii) Unsafe for carrying food

    (iii) Mention the name and address of the manufacturer

  • That the minimum thickness mentioned for recycled bags & virgin bags shall not be less than 20 microns or any minimum thickness as specified by the Government.
  • Further, the carry bags or containers manufactured out of virgin plastic shall be of white color.
  • And lastly, the degradable plastic bags shall meet the international or national quality standards, and it has to be certified by a Government, or the Government approved laboratory in the manner prescribed under the rules.
