Ans.  

Initially you try to contact builder through email or letter. Your next step should be to dispatch a legal notice through lawyer to make pressure on builder. Through that legal notice you can ask builder to give possession within prescribed period of time or you can also claim refund along with interest.

If you receive no reply from builder or even possession, you can approach various legal authorities to help you. First way is to approach Consumer Court. If value of your claim is less than 20 lakh you can approach District forum, if more than 20 lakh than State commission. This remedy is only available to residential property or property used for personal use. If property is to be bought for commercial purpose you cannot approach consumer court. Then the option will be Insolvency proceeding or criminal complaint or suit for recovery.
