Numerous cases have been witnessed, where employer dismissed duties of employee without specifying any reason. Sometimes salaries are not even paid to them. In order to safeguard rights of employees, different legal provisions have been made such as:

  1. You can send a legal notice to employer to release your unpaid salary or can ask to reinstate your services with company.
  2. If no reply has been received or no salary has been disbursed then, you can approach local police station and lodge a complaint for cheating and criminal breach of trust under section 420 and 406 IPC.
  3. If police authorities denied lodging police complaint them you can file a complaint before judicial magistrate in local jurisdiction and pray to ask police authorities to take action against employer.
  4. Even you can write a letter to registrar of companies, awaking ROC about malpractices done in company. You can also share copy of FIR with Roc and ask the authority to take some action.
  5. If your rights have been infringed by your employer and after sending legal notice no action has been taken or salary has not been released then you can also file a civil suit against company.
  6. In most of the cases, issue gets resolved here only, as company doesn’t want to pull the matter further. But if that is not the case you can file a complaint before Labour Commissioner for recovering pending dues or for reinstatement of your services.
