As per Indian laws, no bar is imposed on job selection basis on pendency of trial in any criminal or civil court. But in order to keep transparency, job applicant during procedure to apply for job must disclose any pendency of civil or criminal matter and its details. These details are required to be given in specified format i.e. in attestation form and in affidavit form. 

After submitting attestation form, the screening committee will decide about the nature and severity of offence committed and whether such person is eligible to apply for the post. We have seen certain cases where committee declined the candidature just on basis of pendency of criminal trial but on time to time Supreme court has given numerous directions to department to not to take action just on basis of pendency of trial and to take liberal views in such kind of cases.
